GhostSpeech Terms of Service

These Terms govern your use of the GhostSpeech app, keyboard, website, and related services, collectively called GhostSpeech. By creating an account, signing in, or using GhostSpeech, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use GhostSpeech.

1. Eligibility

You must be at least 13 to use GhostSpeech. If you are not old enough to enter these Terms or consent to data processing under the law where you live, a parent or legal guardian must review and agree on your behalf where the law permits.

2. The service

GhostSpeech is a dictation keyboard for iPhone that converts speech to text and offers Ask, Rewrite, search, and related features. Some features require an internet connection and an account. On supported devices, Private Mode provides certain on-device features. Typing works without Full Access and without a network connection.

3. Your account

You sign in with Sign in with Apple. You are responsible for activity under your account and for keeping your device and account access secure. Notify us promptly if you believe your account has been compromised.

4. Your content and permission to process it

You retain ownership of audio, text, prompts, transcripts, and other content you submit to or create with GhostSpeech. You grant VESTAPLAN, INC. a limited, worldwide license to host, transmit, reproduce, and process that content only as needed to provide, secure, maintain, and support GhostSpeech, comply with law, and improve the service when you have chosen an applicable improvement setting. This license ends when the content is deleted, except to the limited extent retention is legally required or the content has been de-identified.

You represent that you have the rights and permissions needed to submit content. You are responsible for complying with applicable consent, recording, wiretap, privacy, employment, and confidentiality laws. Do not record, transcribe, or process another person's speech or confidential information without authorization where authorization is required.

5. AI and speech output

Speech recognition and AI-generated output can be incomplete, inaccurate, offensive, or unsuitable. Similar or identical output may be provided to other users. You are responsible for reviewing output and deciding whether and how to use it. GhostSpeech does not provide legal, medical, financial, or other professional advice, and you should not rely on it for high-stakes decisions.

As between you and VESTAPLAN, INC., and to the extent permitted by law, you own output generated for you. We do not guarantee that output is protectable or does not resemble content generated for others.

6. Acceptable use

You agree not to use GhostSpeech to violate law or another person's rights; process content you lack permission to process; harass, exploit, or harm others; generate or distribute malware; evade safeguards or usage limits; interfere with or gain unauthorized access to the service; reverse engineer the service except where law permits it; or use automated means to scrape or excessively burden the service.

7. Subscriptions and payments

GhostSpeech offers a free tier and an optional auto-renewable subscription, GhostSpeech Pro. The current price, billing period, and any free trial are shown before you confirm a purchase. A free trial converts to a paid subscription unless canceled before it ends.

Payment is charged to your Apple Account at confirmation. The subscription renews automatically for the same period at the then-current price unless you turn off auto-renew at least 24 hours before the current period ends. Your Apple Account is charged for renewal within the 24 hours before that period ends. You can manage or cancel the subscription in your Apple Account settings. Any unused part of a free trial is forfeited when you purchase a subscription. Purchases, billing, and refunds are handled through the App Store and are subject to its terms.

Deleting GhostSpeech or your GhostSpeech account does not cancel an active subscription. You must cancel it separately through your Apple Account.

8. Privacy and service providers

Our Privacy Policy explains how GhostSpeech handles data. Connected features may use providers that perform cloud speech recognition, generative-AI processing, search and media retrieval, hosting, diagnostics, authentication, and subscription processing on our behalf. Your use of the app is also subject to applicable App Store terms.

9. GhostSpeech intellectual property and feedback

GhostSpeech, including its software, design, branding, and documentation, is owned by VESTAPLAN, INC. or its licensors and protected by law. We grant you a limited, revocable, non-exclusive, non-transferable license to use the app for its intended purpose under these Terms.

If you provide ideas or feedback, you grant us a perpetual, worldwide, royalty-free right to use them without restriction or compensation. This does not give us rights to your user content.

10. Availability, changes, and beta features

GhostSpeech may change over time. We may add, remove, limit, suspend, or modify features, and the service may occasionally be unavailable. Preview or beta features may be less reliable, may change without notice, and are provided for evaluation.

11. Termination and account deletion

You may stop using GhostSpeech and delete your account from inside the app at any time. We may suspend or terminate access if you materially violate these Terms, create risk or legal exposure, or if required by law. Sections that by their nature should survive termination, including ownership, disclaimers, limitations of liability, and miscellaneous terms, will survive.

12. Disclaimers

To the extent permitted by law, GhostSpeech is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee uninterrupted availability, accuracy, or that GhostSpeech will meet every requirement. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

13. Limitation of liability

To the maximum extent permitted by law, VESTAPLAN, INC. and its officers, directors, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunity, arising from GhostSpeech, even if advised that such damages were possible. These limitations do not apply where prohibited by law.

14. Changes to these Terms

We may update these Terms as GhostSpeech evolves. We will post the revised Terms here and update the date above. If a change materially affects your rights, we will provide additional notice appropriate to the change. Continued use after revised Terms take effect constitutes acceptance.

15. Governing law

These Terms are governed by the laws of California, without regard to conflict-of-law rules. Nothing in these Terms limits consumer rights that cannot be waived under the law where you live.

16. Miscellaneous

These Terms and the Privacy Policy are the entire agreement between you and VESTAPLAN, INC. about GhostSpeech. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, reorganization, or sale of assets. Neither party is responsible for delay caused by events beyond its reasonable control.
